Please read these Terms and Conditions (“Terms”) carefully before using the Dakary Nails website and web application (the “Service”) operated by Dakary Nails (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Appointments, Cancellations, and Payments

• Booking: All appointments must be booked through our online scheduling system. The duration of the appointment is dependent on the service(s) selected.
• Cancellation Policy: We require at least 24 hours’ notice for any appointment cancellations. You may cancel your appointment via your client dashboard. If you fail to cancel within this timeframe or do not show up for your appointment, we reserve the right to refuse future service or require a deposit for future bookings.
• Payments: Payments for services are due at the time of your appointment. We accept payments in cash or via Zelle. We do not currently process payments online through the Service.

3. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Dakary Nails. The brand name “Dakary Nails”, the slogan “Aquí tus uñas cuentan una historia”, our logos, and all visual designs are our trademarks and may not be used in connection with any product or service without our prior written consent.

4. User-Generated Content (Photos & Testimonials)

Our Service may allow you to submit, post, or share content, such as photos of your nails or written testimonials (“User Content”).

By providing User Content to us, you grant Dakary Nails a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, display, reproduce, distribute, and prepare derivative works of your User Content in connection with the Service and for our business’s promotion (e.g., on our website gallery and social media channels).

You represent and warrant that you own or have the necessary rights to the User Content you provide and that its use by us will not infringe upon the rights of any third party.

5. Prohibited Activities

You agree not to use the Service for any unlawful purpose or to engage in any of the following prohibited activities:

• Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service.
• Using the Service for any commercial solicitation purposes.
• Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.

6. Third-Party Links

Our Service may contain links to third-party websites or services (such as Instagram and TikTok) that are not owned or controlled by Dakary Nails. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Illinois and the United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Cook County, Illinois.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
